There is also a misconception that is the parties agree to a shared parenting plan, there will be no child support ordered by the Court. Child Support is not determinative solely on the issue of whether there is a shared parenting plan. The Court can still order child support under a shared parenting agreement. The most important part of a shared parenting agreement is the parenting time allocation for each parent. That will be a large factor in determining whether the Court issues an order for child support. Joel G. The child custody issues are determined either through an agreement or through a contested custody trial. The Court understands that child custody is a complicated process and can have long term implications. Joel G. Deutch, Attorney at Law has the experience to understand what needs to occur to be successful at a custody trial. He may request a Guardian Ad Litem to speak on behalf of the children so their wishes will be heard or file a motion for the children to speak directly with the Judge.

Child support is not taxable and is calculated by a formula taking into consideration income of the parents, health insurance and child care costs.   • Spousal Support: Joel is familiar with how the Courts look at spousal support and what factors are used to calculate the amount of support and the length of time you will receive spousal support. You need to understand spousal support is taxable to the recipient spouse. Therefore, you may be better off negotiating a higher amount of child support to offset that taxable income.
  • Modifications of Existing Agreements: If your situation changes after you have signed an agreement, Joel is familiar with the current strategies to change your agreements to benefit you and your children.
  • Paternity: Joel is experienced with the processes the Court uses to prove whether a father is the individual who fathered the child.
  • Visitation: Joel is experienced in determining whether a court will award visitation rights to unmarried parents and what factors the Court examines in awarding visitation during a contested divorce and/or custody case. 
  • Restraining Orders: If the parties are going through a contested divorce and there is potential violence between the parents, Joel is experienced in drafting documents to award one party a restraining order so they are unable to have contact with the other spouse and/or their child.
  • GBLT Family Law Issues: Joel is familiar with the issues that are involved in same sex relationships.
  • Contempt of Existing Court Orders: If one of the parties is not complying with the court ordered agreements, Joel is experienced in bringing actions to Court to make sure the Court will enforce the agreements and protect your rights. 
  • Custody and Visitation Issues for Unmarried Parties: When two parents are unmarried, the law in Ohio states the mother has legal custody of the children. Therefore, if the father wants parenting rights he needs to file an action in Juvenile Court to seek custody, shared parenting and/or visitation. Joel G.
